DESCRIPTION:The Austrian Government plans to introduce a register for security rights in movable property. Such a register could facilitate the financing of Austrian businesses and improve their access to liquidity. But how should such a register be designed? They will present their national experiences with security rights registers and discuss their respective strengths and weaknesses. DESCRIPTION:From 11 to 12 April 2024\, a conference on “Digital Assets and Private International Law” will be held at the University of Vienna. \nOutline: \nDigital assets\, such as cryptocurrencies\, stablecoins and other tokens\, have become important as objects of investment and trade. They are recorded on the blockchain\, an electronic ledger held in identical form on servers (nodes) all over the world. Therefore\, the determination of the governing law presents particular challenges. This conference will explore whether Private International Law methodology can be successfully applied to digital assets or whether it needs to be changed in light of the ‘blockchain revolution’. \nDate: 11 and 12 April 2024 \nPlace: Juridicum. Bazinas Introductory Remarks\nProf. Akseli will present the potential use of a blockchain based distributed ledger platform as a registry for security rights as well as its interac-tion with the principles of the UNCITRAL Model Law on Secured Transactions (‘MLST’). This type of technology has the potential to revolutionise the third party effectiveness of security inter-ests. In this process\, the modern principles of the MLST could play a pivotal role in reducing the cost of credit and expanding the financial inclu-sion of small businesses and individuals. Block-chain and distributed ledger technology through disintermediation have the necessary characteristics to decentralise and streamline the registra-tion of security interests. The technology can also support the taking of security interests on digital assets. SUMMARY:Evidence\, Argument\, and Reason in an Era of „Post-Truth“ Politics and Law
DESCRIPTION:Professor Scott Brewer will present a lecture on the topic of the relation between evidence and reason in a world of “post truth” politics and law.  The Enlightenment project sought to place reason at the center of understanding both the world and the human being.  On this view\, evidence was an essential tool of reasoned understanding – evidence from the world\, from the study of humans’ political and social existence\, and from introspection of the human mind itself.  But this faith in reason and reasoned evidence became\, and remains\, deeply shaken.  In part\, this shaken faith was enabled by the work of three great Doubters: Nietzsche (who taught that we should be suspicious of our religious\, moral\, and political beliefs and actions)\, Freud (who taught that we should doubt our psychological motives)\, and Marx (who taught that we should doubt our economic and political motives).  These three great types of doubt have received support and energy in what is now widely referred to as the era of “post-truth” politics.  In a “post-truth\,” or “non-truth” political or legal space\, canons that call for careful weighing of evidence and the testing of judgments about what is true are either overtly rejected and disparaged or silently disrespected and unheeded. \nThe shaken Enlightenment commitment to reason and evidence rests deeply on a commitment to arguments that reason with evidence presented.  Professor Brewer will address the question\, How does the close analysis of evidence and argument illuminate the problem of post-truth\, or non-truth\, politics and law? What are the criteria of good argument and evidence in politics and law? What can a focus on the nature of argument and evidence tell us about the viability of the Enlightenment commitment to using reason to create a prosperous\, just\, fair society?

DESCRIPTION:Die ehemaligen kolonisierten Inseln in der Karibik und heutigen überseeischen Gebietsteile des Königreichs der Niederlande waren mehrere Jahrzehnte ein Staat mit dem Namen Niederländische Antillen. Zuerst folgte der Austritt von Aruba aus dem Inselverbund und 2010 kam eine grosse Staatsreform. Nun sind Curacao\, Aruba und Sint Maarten eigene Staaten im Königreich der Niederlande und für die drei kleineren\, sogenannten BES-Inseln\, Bonaire\, Sint Eustachius und Saba\, wurde ein eigener Status geschaffen. Jede dieser Einheiten kennt ein eigenes Zivilgesetzbuch. Die Inseln sind aber kein Teil der Europäischen Union und somit ist auch keine Umsetzung des acquis communautaire nötig. Das Verbraucherrecht ist daher sehr unterschiedlich auf den Inseln. Verbraucherschutzorganisationen sind noch im Entstehen. \nNur Aruba ist Mitglied des UN-Kaufrechts geworden. Das Statut für das Königreich der Niederlande\, ein Gesetz im Verfassungsrang\, regelt die Beziehung zu den Niederlanden in Europa und sieht vor\, dass auf Grund eines Konkordanzprinzips weitgehend Einheit im Zivilrecht bestehen soll. Der Hoge Raad der Niederlande ist für alle sieben Gebietsteile\, von Den Haag bis in die Karibik\, der höchste Richter\, aber nur für die europäischen niederländischen Gebietsteile muss er richtlinienkonform Recht sprechen.

DESCRIPTION:Family law for a long time was only centred on one particular family unit: a man and a woman united in (indissoluble) marriage\, and with children. But we now live in a world where marriages often end in divorce; where categories of gender are not as fixed as they used to be and legal men can give birth to children; where children are not necessarily genetically related to their birthparents or indeed may have three genetic parents\, and even more social parents. The law has been too slow to react to societal changes and medical advances\, and these issues need to be dealt with as a matter of urgency.

DESCRIPTION:The past decade has witnessed an amazing acceleration in the development of private international law legislation in China as well as a signicant progress in the quality thereof. In 2010\, the Standing Committee of the National People’s Congress adopted China’s rst statute on private international law (Private International Law Act). The adoption of the Act is a historic event in Chinese legislative history\, as it indicates that China has modernised its conflict of law rules after many years of unremitting eorts made by legislators and scholars. Moreover\, the Supreme People’s Court of the PRC promulgated an Interpretation (I) of the Private International Law Act in 2013. The Interpretation (I) attempts to provide concrete explanations on the abstract articles mainly in Chapter One of the Act and to create new provisions to close the legal loopholes. In this respect\, the adoption of the Interpretation (I) can be regarded as a large step towards building a modern private international law system. Hence\, Chinese private international law has witnessed a silent revolution. \nAs its heading suggests\, this lecture seeks to make an objective and comprehensive assessment of the latest development of private international law legislation in China. The lecture will begin with introducing the legislative background of Chinese private international law. Subsequently it will make an objective and comprehensive assessment of the latest Chinese legislation in the eld of private international law. In the end\, the lecture will summarise the striking features as well as the defects of China’s latest legislation and outline the steps to improve it.

In particular\, the following perspectives and challenges will be considered: \n(a) developing innovative logics and argumentation frameworks for modelling and representing legal interpretation and interpretive canons;\n(b) devising adequate and comprehensive logical models for understanding and reconstructing norm change mechanisms and legal dynamics;\n(c) studying the game-theoretic nature of argumentation in the law and identifying what game types can be used in general to model strategic legal dialogues;\n(d) combining deontic logics with other systems – e.g.\, action logics\, epistemic logics\, preference logics – to grasp legal concepts such as trust\, responsibility\, and influence. \nIn a second part this will be complemented by a discussion on how mathematical methods might help to classify and model knowledge in legal systems. DESCRIPTION:Die neoklassische Theorie basiert auf dem Modell des homo oeconomicus\, der eigennützig und rational handelt. Hinzu kommt die stillschweigende Annahme der unbegrenzten Wil-lenskraft\, d.h. dass einmal gefällte Entscheidungen auch in die Tat umgesetzt werden. Zahl-reiche empirische Studien haben gezeigt\, dass die Annahmen der neoklassischen Theorie in der Realität oft nicht zutreffen. Durch die Verhaltensökonomie wird in erster Linie die Ratio-nalitätsannahme hinterfragt. \nDaniel Kahneman unterscheidet zwei Denksysteme: einen schnellen\, intuitiven Denkmodus (System 1) und einen langsamen\, rationalen Denkmodus (System 2). Denkmodus 1 bedient sich kognitiver Faustregeln („heuristics“)\, die zu kognitiven Verzerrungen („biases“) führen können. Sunstein vor\, die Entscheidungsarchitektur („choice architecture“) der Individuen so zu gestalten\, dass diese in eine bestimmte Richtung „gestupst“ werden. \nBeispiele solcher Stupser („nudges“) sind sog. defaults (z.B. Wider-spruchslösung bei der postmortalen Organspende)\, aber auch andere Maßnahmen wie z.B. Fliegen-Sticker in Toiletten zur Erhöhung der Hygiene oder die Platzierung der gesunden Nahrungsmittel in Kantinen an gut sichtbaren Stellen. Da beim Nudging das Individuum nicht zu einem bestimmten Verhalten gezwungen wird\, handelt es sich um eine Form des weichen Paternalismus („libertarian paternalism“). Kritiker bemängeln\, dass das Instrument intrans-parent und manipulativ sei. Außerdem maße sich der Staat ein Wissen an\, das er nicht habe.

DESCRIPTION:The main focus of the lecture will be the concept of the best interests of the child\, stipulated in the UN Convention on the Rights of the Child. This concept is considered to be one of the most important and difficult to be applied in practice. In family-related situations\, there are many factors that need to be taken into account when assessing what is in the best interests of a particular child. This task with regard to what is called ‘new forms of families’ or ‘alternative families’ is even much more difficult. \nAt the same time this is increasingly becoming an evolving issue in Europe. Apart from that\, it is often linked to another complicated and challenging topic – the right of a child who was born as the result of assisted reproduction and/or was adopted to know his or her origin. Although the legal regulation of all these issues is different in different countries\, and it is ‘still new territory’\, we may find some guidance in case-law of some of the European countries and in the ECHR jurisprudence.

Die Diskutanten gehen dieser Thematik im Hinblick auf die Kinderrechte\, insbesondere das Recht auf körperliche Unversehrtheit\, das elterliche Erziehungsrecht sowie das Grundrecht auf Religionsfreiheit nach.

SUMMARY:Prof. Philippe LORTIE - Direct judicial communications under the 1980 Hague Child Abduction Convention and the International Hague Network of Judges
DESCRIPTION:The principal aim of the International Hague Network of Judges (IHNJ) is to improve the operation of the Hague Child Abduction Convention and the handling of other cross-border civil cases relating to children by promoting international judicial co-operation. By creating direct contact points between members of the judiciary in different States\, speedier and more satisfactory resolutions of cross-border disputes involving children\, and in particular child abduction cases\, will be achieved. The IHNJ also allows for the exchange of information between judges to increase knowledge and improve practice under the 1980 Convention and under other Hague Children’s Conventions\, as appropriate. \nFurther to presenting the IHNJ\, the Emerging Guidance regarding the development of the IHNJ and the General Principles for Judicial Communications\, including commonly accepted safeguards for Direct Judicial Communications in specific cases\, within the context of the IHNJ\, Mr. Lortie will present examples of cases in which direct judicial communications took place. A discussion will follow with regard to other areas of the law where such communications could take place.

SUMMARY:Prof. GU Minkang - Development of Enterprises: Systems and Relevant Theories from the Angle of Company Law
DESCRIPTION:According to traditional company law theories\, there are at least ve dierences between a Company and a partnership: \n(1) a company is a legal person while a partnership (or sole proprietorship) is not\,\n(2) shareholders of a company can enjoy limited liability while partners bear unlimited liability\,\n(3) a company faces double Taxation while a partnership does not pay taxes\,\n(4) a Company has an independent personality and enjoys an independent management power while in a partnership situation\, only partners operate the business\,\n(5) a company is mainly regulated by law while partnership is mainly regulated by contract. \nBased on the recent developments of US Company law and other business laws\, this lecture intends to point out that these distinctions are becoming vague because there is a tendency towards companies and partnership sharing more similarities. Thus\, this lecture tries to outline some changes of company law theories in the near future.

SUMMARY:Prof. Franz Werro - European Private Law: Quo Vadis?
DESCRIPTION:European private law has been in the making for a number of decades. The main goal has been to serve the needs of the Single Market. Despite a variety of eorts to make national private laws converge\, little unity has emerged. Nevertheless\, the Single Market has survived and even grown. This talk oers a critical assessment of the EU’s achievements in the development of European private law. It will examine how the ECJ has interpreted the EU Directives in key areas of contract and tort\, and ask to what extent the case law of the European court has harmonized the law in these elds. \nThe presentation will also reect on possible alternatives to the Directives\, and question the meaning and need of codifying attempts such as the one proposed in the Law of Sales in 2011 (CESL). More generally\, the talk will reect on legal and cultural diversity in Europe. In particular\, it will ask how language determines the way we think\, and whether one law can be expressed in more than language. As private law is an expression of culture\, it may be that European private is impossible to achieve\, as long as cultures remain dierent from one country to the other.
