Alle genannten Themenfelder stellen eine Rechtsordnung\, die sich den Schutz der Kinder zur Aufgabe macht\, vor besondere Herausforderungen. \nKinderrechte sind ein fundamentaler Bestandteil des Familienrechts. Sie sind durch die UN-Kinderrechtskonvention und EU-Grundrechtecharta abgesichert und genießen in Österreich auch verfassungsrechtlichen Schutz. SUMMARY:Evidence\, Argument\, and Reason in an Era of „Post-Truth“ Politics and Law
DESCRIPTION:Professor Scott Brewer will present a lecture on the topic of the relation between evidence and reason in a world of “post truth” politics and law.  The Enlightenment project sought to place reason at the center of understanding both the world and the human being.  On this view\, evidence was an essential tool of reasoned understanding – evidence from the world\, from the study of humans’ political and social existence\, and from introspection of the human mind itself.  But this faith in reason and reasoned evidence became\, and remains\, deeply shaken.  In part\, this shaken faith was enabled by the work of three great Doubters: Nietzsche (who taught that we should be suspicious of our religious\, moral\, and political beliefs and actions)\, Freud (who taught that we should doubt our psychological motives)\, and Marx (who taught that we should doubt our economic and political motives).  These three great types of doubt have received support and energy in what is now widely referred to as the era of “post-truth” politics.  In a “post-truth\,” or “non-truth” political or legal space\, canons that call for careful weighing of evidence and the testing of judgments about what is true are either overtly rejected and disparaged or silently disrespected and unheeded. \nThe shaken Enlightenment commitment to reason and evidence rests deeply on a commitment to arguments that reason with evidence presented.  Professor Brewer will address the question\, How does the close analysis of evidence and argument illuminate the problem of post-truth\, or non-truth\, politics and law? What are the criteria of good argument and evidence in politics and law? What can a focus on the nature of argument and evidence tell us about the viability of the Enlightenment commitment to using reason to create a prosperous\, just\, fair society?

DESCRIPTION:Die ehemaligen kolonisierten Inseln in der Karibik und heutigen überseeischen Gebietsteile des Königreichs der Niederlande waren mehrere Jahrzehnte ein Staat mit dem Namen Niederländische Antillen. Zuerst folgte der Austritt von Aruba aus dem Inselverbund und 2010 kam eine grosse Staatsreform. Nun sind Curacao\, Aruba und Sint Maarten eigene Staaten im Königreich der Niederlande und für die drei kleineren\, sogenannten BES-Inseln\, Bonaire\, Sint Eustachius und Saba\, wurde ein eigener Status geschaffen. Jede dieser Einheiten kennt ein eigenes Zivilgesetzbuch. Die Inseln sind aber kein Teil der Europäischen Union und somit ist auch keine Umsetzung des acquis communautaire nötig. Das Verbraucherrecht ist daher sehr unterschiedlich auf den Inseln. Verbraucherschutzorganisationen sind noch im Entstehen. \nNur Aruba ist Mitglied des UN-Kaufrechts geworden. Das Statut für das Königreich der Niederlande\, ein Gesetz im Verfassungsrang\, regelt die Beziehung zu den Niederlanden in Europa und sieht vor\, dass auf Grund eines Konkordanzprinzips weitgehend Einheit im Zivilrecht bestehen soll. Der Hoge Raad der Niederlande ist für alle sieben Gebietsteile\, von Den Haag bis in die Karibik\, der höchste Richter\, aber nur für die europäischen niederländischen Gebietsteile muss er richtlinienkonform Recht sprechen.

The law has been too slow to react to societal changes and medical advances\, and these issues need to be dealt with as a matter of urgency.

DESCRIPTION:The past decade has witnessed an amazing acceleration in the development of private international law legislation in China as well as a signicant progress in the quality thereof. In 2010\, the Standing Committee of the National People’s Congress adopted China’s rst statute on private international law (Private International Law Act). The adoption of the Act is a historic event in Chinese legislative history\, as it indicates that China has modernised its conflict of law rules after many years of unremitting eorts made by legislators and scholars. Moreover\, the Supreme People’s Court of the PRC promulgated an Interpretation (I) of the Private International Law Act in 2013. The Interpretation (I) attempts to provide concrete explanations on the abstract articles mainly in Chapter One of the Act and to create new provisions to close the legal loopholes. In this respect\, the adoption of the Interpretation (I) can be regarded as a large step towards building a modern private international law system. Hence\, Chinese private international law has witnessed a silent revolution. \nAs its heading suggests\, this lecture seeks to make an objective and comprehensive assessment of the latest development of private international law legislation in China. The lecture will begin with introducing the legislative background of Chinese private international law. Subsequently it will make an objective and comprehensive assessment of the latest Chinese legislation in the eld of private international law. In the end\, the lecture will summarise the striking features as well as the defects of China’s latest legislation and outline the steps to improve it.

In particular\, the following perspectives and challenges will be considered: \n(a) developing innovative logics and argumentation frameworks for modelling and representing legal interpretation and interpretive canons;\n(b) devising adequate and comprehensive logical models for understanding and reconstructing norm change mechanisms and legal dynamics;\n(c) studying the game-theoretic nature of argumentation in the law and identifying what game types can be used in general to model strategic legal dialogues;\n(d) combining deontic logics with other systems – e.g.\, action logics\, epistemic logics\, preference logics – to grasp legal concepts such as trust\, responsibility\, and influence. \nIn a second part this will be complemented by a discussion on how mathematical methods might help to classify and model knowledge in legal systems. Moreover\, the power of inference engines and their possible applications in judicature\, and abstract semantic models and their applicability to law will be reflected.

DESCRIPTION:Die neoklassische Theorie basiert auf dem Modell des homo oeconomicus\, der eigennützig und rational handelt. Hinzu kommt die stillschweigende Annahme der unbegrenzten Wil-lenskraft\, d.h. dass einmal gefällte Entscheidungen auch in die Tat umgesetzt werden. Zahl-reiche empirische Studien haben gezeigt\, dass die Annahmen der neoklassischen Theorie in der Realität oft nicht zutreffen. Durch die Verhaltensökonomie wird in erster Linie die Ratio-nalitätsannahme hinterfragt. \nDaniel Kahneman unterscheidet zwei Denksysteme: einen schnellen\, intuitiven Denkmodus (System 1) und einen langsamen\, rationalen Denkmodus (System 2). Denkmodus 1 bedient sich kognitiver Faustregeln („heuristics“)\, die zu kognitiven Verzerrungen („biases“) führen können. Um die Entscheidungen der Individuen zu verbes-sern\, schlagen Richard Thaler und Cass R. Sunstein vor\, die Entscheidungsarchitektur („choice architecture“) der Individuen so zu gestalten\, dass diese in eine bestimmte Richtung „gestupst“ werden. \nBeispiele solcher Stupser („nudges“) sind sog. defaults (z.B. Wider-spruchslösung bei der postmortalen Organspende)\, aber auch andere Maßnahmen wie z.B. Fliegen-Sticker in Toiletten zur Erhöhung der Hygiene oder die Platzierung der gesunden Nahrungsmittel in Kantinen an gut sichtbaren Stellen. Da beim Nudging das Individuum nicht zu einem bestimmten Verhalten gezwungen wird\, handelt es sich um eine Form des weichen Paternalismus („libertarian paternalism“). Kritiker bemängeln\, dass das Instrument intrans-parent und manipulativ sei. Außerdem maße sich der Staat ein Wissen an\, das er nicht habe.

Apart from that\, it is often linked to another complicated and challenging topic – the right of a child who was born as the result of assisted reproduction and/or was adopted to know his or her origin. Although the legal regulation of all these issues is different in different countries\, and it is ‘still new territory’\, we may find some guidance in case-law of some of the European countries and in the ECHR jurisprudence.

DESCRIPTION:The principal aim of the International Hague Network of Judges (IHNJ) is to improve the operation of the Hague Child Abduction Convention and the handling of other cross-border civil cases relating to children by promoting international judicial co-operation. By creating direct contact points between members of the judiciary in different States\, speedier and more satisfactory resolutions of cross-border disputes involving children\, and in particular child abduction cases\, will be achieved. The IHNJ also allows for the exchange of information between judges to increase knowledge and improve practice under the 1980 Convention and under other Hague Children’s Conventions\, as appropriate. \nFurther to presenting the IHNJ\, the Emerging Guidance regarding the development of the IHNJ and the General Principles for Judicial Communications\, including commonly accepted safeguards for Direct Judicial Communications in specific cases\, within the context of the IHNJ\, Mr. Lortie will present examples of cases in which direct judicial communications took place. A discussion will follow with regard to other areas of the law where such communications could take place.

DESCRIPTION:According to traditional company law theories\, there are at least ve dierences between a Company and a partnership: \n(1) a company is a legal person while a partnership (or sole proprietorship) is not\,\n(2) shareholders of a company can enjoy limited liability while partners bear unlimited liability\,\n(3) a company faces double Taxation while a partnership does not pay taxes\,\n(4) a Company has an independent personality and enjoys an independent management power while in a partnership situation\, only partners operate the business\,\n(5) a company is mainly regulated by law while partnership is mainly regulated by contract. \nBased on the recent developments of US Company law and other business laws\, this lecture intends to point out that these distinctions are becoming vague because there is a tendency towards companies and partnership sharing more similarities. Thus\, this lecture tries to outline some changes of company law theories in the near future.

SUMMARY:Prof. Franz Werro - European Private Law: Quo Vadis?
DESCRIPTION:European private law has been in the making for a number of decades. The main goal has been to serve the needs of the Single Market. Despite a variety of eorts to make national private laws converge\, little unity has emerged. Nevertheless\, the Single Market has survived and even grown. This talk oers a critical assessment of the EU’s achievements in the development of European private law. It will examine how the ECJ has interpreted the EU Directives in key areas of contract and tort\, and ask to what extent the case law of the European court has harmonized the law in these elds. \nThe presentation will also reect on possible alternatives to the Directives\, and question the meaning and need of codifying attempts such as the one proposed in the Law of Sales in 2011 (CESL). More generally\, the talk will reect on legal and cultural diversity in Europe. In particular\, it will ask how language determines the way we think\, and whether one law can be expressed in more than language. As private law is an expression of culture\, it may be that European private is impossible to achieve\, as long as cultures remain dierent from one country to the other.

DESCRIPTION:There are many conceptions of constitutionalism\, and many aspects of it even within particular conceptions. But one important dimension of constitutionalism is the way in which constitutions impose second-order constraints on first-order policy\, political\, and moral preferences. Policies or decisions that might on the balance of reasons be wise may still be unconstitutional because they are procedurally imperfect or\, more importantly\, because they violate rights-based side constraints on otherwise advantageous policies. Even welfare- or happiness- or utility-maximizing policies may still be unconstitutional because they infringe on\, for example\, rights to equality\, or rights of freedom of expression or freedom of religion\, or the rights of those charged with crimes. \nSometimes constitutions impose such second-order constraints on first-order policies because of a concern with the long term rather than with what will be immediately beneficial. And sometimes constitutional constraints emerge from the recognition of fundamental individual human rights. But once we recognize that serious enforcement of constitutional constraints will lead to the invalidation of genuinely (at least in the short or intermediate term) wise or beneficial policies\, we can understand that constitutionalism comes at some cost to the general welfare. Dealing with how such costs should be understood\, recognized\, and allocated is one of the most important yet least appreciated aspects of constitutionalism\, and one of the problems that any robust constitutional culture must face.

DESCRIPTION:The Hague Convention on the Civil Aspects of International Child Abduction (“Abduction Convention”) 1980 came into force in December 1983. A central objective of the conventions concluded under the auspices of the Hague Conference on Private International Law is to harmonize the law governing topics involving international elements. The more widely ratified the Convention\, the greater the extent to which this objective appears to be realized. In this respect\, the Abduction Convention can perhaps be seen as the most successful of all the Hague Conventions\, with 92 Member States (as of April 2014). However\, true harmonization also requires uniformity in interpretation and implementation of the Convention . \nThis lecture will discuss some of the disparities in the way in which the Abduction Convention has been applied in different Members States over the last thirty years; consider possible reasons for those disparities and make suggestions as to how to promote greater uniformity. \nThe lecture will concentrate on the differing interpretations given to key concepts in the Convention by courts in different jurisdictions and different approaches to the applicability of the exceptions in frequently recurring fact situations\, but reference will also be made to institutional and procedural discrepancies.

SUMMARY:Prof. Samuel R. SIMON - Conflict of Laws and Core American Constitutional Values: The Collision of Freedom of the Press and a Criminal Defendants Fundamental Constitutional Rights
DESCRIPTION:This lecture by a distinguished practicing attorney and professor of law addresses the issues that arise in the United States when the constitutional right of a free press collides with a criminal defendant’s constitutional rights to a fair trial\, to a fair and impartial jury\, and to due process of law. \nIn the American criminal justice system\, an accused criminal defendant is innocent until proven guilty at trial. To this end\, he enjoys a panoply of unalienable constitutional rights that the courts jealously guard at each stage of the proceedings. Equally\, every American school child knows that freedom of the press — the constitutional freedom to publish without let or hindrance — is protected by the courts to the utmost possible extent. These rights may collide in any number of ways. When they do\, it falls to the judiciary to balance the press’s constitutional right to publish — which is correlative to the public’s right to know — with the constitutional protections given to everyone accused of a crime\, no matter how heinous. \nOne of the most difficult factual scenarios presented by such a collision arises in the context where the news media publishes articles based on confidential or private information that the reporter obtained in violation of a court order prohibiting its dissemination. As well as the conflicts that result from constitutional tensions (“free press vs. fair trial”)\, core conflict of laws principals are implicated when the reporter gathering the information is acting under color of the law of a state that provides an absolute privilege for such activities\, but the criminal prosecution that gave rise to the non-dissemination order occurs in another state with another body of law\, a state where the reporter is accorded\, at best\, only a qualified privilege. \nThe lecture by Visiting Guest Professor Simon\, which should be of interest to everyone concerned with comparative law and conflict of laws issues\, discusses and analyzes these conflicts in depth\, and suggests a mechanism by which the courts may render justice where\, as here\, fundamental constitutional and statutory rights collide. Ample opportunity for questions will be offered.

In nations adopting a federal system\, such as the United States of America\, Australia and India\, local governments\, especially state or provincial governments\, are the basis for the establishment of federal government\, which is the central government. In nations\nadopting a unitary system\, such as the United Kingdom (“the UK”) and China\, the purpose to set up local governments is to administer the state aairs more eciently. In many nations\, either federal or unitary\, all local governments have the same kind of relationship with the central government. That means all local governments have exactly the same degree of autonomy and jurisdiction. In some other nations\, however\, due to their dierent historical development\, dierent local governments may have dierent kinds of relationship with\nthe central government. \nChina is a unitary nation adopting the people’s congress system as its form of government. There exist four kinds of local governments at provincial level\, enjoying dierent degree of autonomy in China. This lecture intends to examine the future of central-local relationship under the people’s congress system\, especially\, (i) whether the existing status of central-local relationship is compatible with the people’s congress system\, (ii) whether the current status is the best arrangement\, and (iii) if not what is the possible future development?

SUMMARY:Prof. Dozhdev - Development of Property Rights in the Russian Federation: European Legal Tradition and Post-Soviet Transition
DESCRIPTION:The system of property rights in the current Russian legal framework as well as in the proposed Draft Amendments to the Civil Code (which will be adopted in 2014) are analyzed from a comparative law perspective. \nThe lecture will focus on both the conceptual framework of property rights in the Russian legal system as well as on practical issues in regard to judicial protection\, acquisition and limitation of ownership and other real rights. In addition\, the social and economic implications of the concept of property will be discussed. \nIn a systematic analysis\, property rights according to the Continental European tradition are contrasted with concepts and notions of Common Law. In this context\, the problems of eventual legal transplantation are thoroughly assessed. The examination of the immanent reforms of the Russian Civil Code reveals principles of the European legal tradition\, stimulates critical thinking and contributes considerably to the development of professional skills.

SUMMARY:Prof. Heinsohn - Introduction to the Theory of Ownership-based Economics with a View on the current Global Crisis
DESCRIPTION:Gunnar HEINSOHN\, Professor emeritus of the University Bremen\, is a historian\, sociologist and economist\, who elaborated — together with Otto STEIGER — a specic theory of modern economics\, namely the theory of ownership-based economics. \nThis theory deals with a symptomatic lacune of mainstream economics — this being the absence of any theoretical explanation of money and interest in mainstream economics — and focuses on legal institutions such as rights in rem (ownership) and contracts (credit agreements) to explain the origins of money and modern business cycles. \nThe key elements of mainstream economics\, such as the pretense of universalism and the assumption of a homo oeconomicus and his self-interest driven rationality\, are amongst those building blocks of contemporary economics which are in the focus of HEINSOHN‘s (and STEIGER‘s) critique. \nAt the ocassion of his visit to Vienna\, Professor HEINSOHN will present an introduction to his theory of ownershipbased economics. The tools developed by way of this introduction will be used to engage in a description and analysis of the current systemic crisis of the globalized economy.

SUMMARY:Prof. Scott Brewer - Universality of Logic and Globalisation of Legal Analysis
DESCRIPTION:Laws of nation states and laws of logic: The law of every existing legal system is local to time\, place\, and country. That proposition is central to Legal Positivist legal theories that are so familiar to jurists (professors and students) at this august institution who are so robustly aware of Hans Kelsen’s seminal jurisprudence. That proposition is also acknowledged by any plausible “natural law” theory of law. Logic has been well and powerfully characterized\, in the work of great philosophical logicians as diverse and influential as Gottfried Wilhelm Leibniz and Gottlob Frege\, as the discipline that articulates universal “laws of thought\,” local to neither time nor place nor country nor person. \nIn this presentation I shall describe a method of analysis\, the Logocratic Method\, that provides an explanation of both law and logic that captures the locality of law and the universality of logic. I shall explain how the Logocratic Method enables\, enhances\, and empowers critical analysis of the strengths and weaknesses of legal arguments\, which are at the heart of all local legal analysis. In providing this explanation\, I share and reinterpret and articulate Leibniz’ aspiration — high and deep and\, alas\, never fully realized by him — for what he called the “new general science for the instauration and development of the sciences for the benefit of public happiness”: \nWe will present here\, thus\, a new and marvelous calculus\, which occurs in all our reasonings and which is not less rigorous than arithmetic or algebra. Through this calculus\, it is always possible to terminate that part of a controversy that can be determined from the data\, by simply taking a pen\, so that it will suffice for two debaters (leaving aside issues of agreement about words) to say to each other: let us calculate! In this way\, just as when two arithmeticians dispute about a calculation mistake\, so too the method I am proposing will yield the same solution\, including for ignorant persons or for those who are not willing to use it. . . . We will conclude with an exhortation addressed to those persons who are most illustrious by virtue of dignity and knowledge\, about their opportunity to increment immensely human happiness in a short time\, if only we wish to do so.1 \nAfter outlining the Logocratic Method\, I conclude my exploration of the locality of the laws of nation-states and the universality of logic with a brief critical discussion of a legal paradox that Leibniz addressed in his doctoral dissertation on law\, a “perplexing” case that he sought to resolve as part of his lifelong effort to bring “the light of reason” to law through the use of logic. I argue that Leibniz\, great master of logic though he was\, failed to use the full resources of logic to resolve this particular paradox\, and that the Logocratic Method\, properly applied here\, provides one example of the deep utility of logic for explaining how legal argument both can\, and all too often does\, fail to meet the legitimate demands of universal logical integrity. \n1: Gottfried Wilhelm Leibniz: The Art of Controversies. SUMMARY:Dr. Fan Yang - Mediation and its Impact on Legal Systems in Asia-Pacific
DESCRIPTION:Mediation plays an ever more important role in the resolution of disputes around the world. While attention to mediation continues to grow both within and outside of the Asia-Pacific region\, scholarship and research on the impact of mediation on legal systems and legal cultures remains sparse. Before a meaningful comparison of the role that mediation plays in different legal systems can be advanced\, some fundamental questions need to be answered. \nAlthough Asian cultures traditionally favour harmony and reconciliation over litigation and adjudication\, this broad generalization requires careful analysis of regional diversity and its underlying reasons\, as will be demonstrated by the study presented in this lecture. Differences in understanding are likely to be at their greatest when parties from different jurisdictions interact through the mediation process. Even where parties are from jurisdictions with similar laws\, cultural differences may lead to significantly different views of what constitutes appropriate or effective mediation practice. \nThis lecture presents a comparative study of the mediation practice in some selected jurisdictions\, including Australia\, Austria\, Canada\, China (Mainland)\, Chinese Taipei\, Hong Kong SAR\, India\, Indonesia\, Japan\, Korea\, New Zealand\, Singapore\, Thailand and the United States. It seeks to provide some valuable insights into the issues facing the mediators\, jurists\, practitioners and scholars in the respective jurisdictions.

Face l’ampleur des problèmes posés et aux oppositions radicales qui séparent désormais les Etats européens\, praticiens et chercheurs ont été amenés à repenser une partie des mécanismes du droit international privé et à imaginer des solutions nouvelles\, inspirées notamment de la théorie de la reconnaissance. Même si la Cour EDH des droits de l’homme (arrêt Schalk et Kopf c. Autriche) et la CJUE font preuve d’une grande prudence\, pourrait s’affirmer peu à peu un véritable principe de libre circulation des mariages homosexuels (et au delà des situations familiales) valablement créés à l’étranger\, dans le prolongement des arrêts Wagner c. Luxembourg et Négrépontis-Giannisise c. Grèce de la Cour EDH et de des arrêts Garcia Avello et Sayn-Wittgenstein de la CJUE.

SUMMARY:Philippe Lortie - The 2007 Hague Child Support Convention – Opportunities for Domestic Reforms
DESCRIPTION:Further to providing a picture of the international recovery of child support before the 2007 Hague Child Support Convention and presenting an overview of the 2007 Hague Child Support Convention\, Mr. Lortie will highlight the practical challenges in this area of the law such as the increasing number of divorces and the resulting number of child support cases\, the budget crises experienced by many States and the role of States in providing welfare\, social security payments in lieu of the child support that should normally be provided by the parents. \nAgainst this background\, Mr. Lortie will present opportunities for domestic law reforms in relation to the recovery of child support with respect to matters such as: effective access to procedures (e.g.\, administrative versus court-based systems); the location of the debtor; the establishment of parentage; the determination of the amount of maintenance to be paid; the swift recognition\, enforceability and effective enforcement of decisions; information technology; and\, questions of applicable law.
