SUMMARY:Prof. Frederick Schauer - Constitutionalism and its Costs
DESCRIPTION:There are many conceptions of constitutionalism\, and many aspects of it even within particular conceptions. But one important dimension of constitutionalism is the way in which constitutions impose second-order constraints on first-order policy\, political\, and moral preferences. Policies or decisions that might on the balance of reasons be wise may still be unconstitutional because they are procedurally imperfect or\, more importantly\, because they violate rights-based side constraints on otherwise advantageous policies. Even welfare- or happiness- or utility-maximizing policies may still be unconstitutional because they infringe on\, for example\, rights to equality\, or rights of freedom of expression or freedom of religion\, or the rights of those charged with crimes. \nSometimes constitutions impose such second-order constraints on first-order policies because of a concern with the long term rather than with what will be immediately beneficial. And sometimes constitutional constraints emerge from the recognition of fundamental individual human rights. But once we recognize that serious enforcement of constitutional constraints will lead to the invalidation of genuinely (at least in the short or intermediate term) wise or beneficial policies\, we can understand that constitutionalism comes at some cost to the general welfare. Dealing with how such costs should be understood\, recognized\, and allocated is one of the most important yet least appreciated aspects of constitutionalism\, and one of the problems that any robust constitutional culture must face.

SUMMARY:Prof. Schuz - Disparity and the Quest for Uniformity in Implementing the Hague Child Abduction Convention
DESCRIPTION:The Hague Convention on the Civil Aspects of International Child Abduction (“Abduction Convention”) 1980 came into force in December 1983. A central objective of the conventions concluded under the auspices of the Hague Conference on Private International Law is to harmonize the law governing topics involving international elements. The more widely ratified the Convention\, the greater the extent to which this objective appears to be realized. In this respect\, the Abduction Convention can perhaps be seen as the most successful of all the Hague Conventions\, with 92 Member States (as of April 2014). However\, true harmonization also requires uniformity in interpretation and implementation of the Convention . \nThis lecture will discuss some of the disparities in the way in which the Abduction Convention has been applied in different Members States over the last thirty years; consider possible reasons for those disparities and make suggestions as to how to promote greater uniformity. \nThe lecture will concentrate on the differing interpretations given to key concepts in the Convention by courts in different jurisdictions and different approaches to the applicability of the exceptions in frequently recurring fact situations\, but reference will also be made to institutional and procedural discrepancies.

SUMMARY:Prof. Samuel R. SIMON - Conflict of Laws and Core American Constitutional Values: The Collision of Freedom of the Press and a Criminal Defendants Fundamental Constitutional Rights
DESCRIPTION:This lecture by a distinguished practicing attorney and professor of law addresses the issues that arise in the United States when the constitutional right of a free press collides with a criminal defendant’s constitutional rights to a fair trial\, to a fair and impartial jury\, and to due process of law. \nIn the American criminal justice system\, an accused criminal defendant is innocent until proven guilty at trial. To this end\, he enjoys a panoply of unalienable constitutional rights that the courts jealously guard at each stage of the proceedings. Equally\, every American school child knows that freedom of the press — the constitutional freedom to publish without let or hindrance — is protected by the courts to the utmost possible extent. These rights may collide in any number of ways. When they do\, it falls to the judiciary to balance the press’s constitutional right to publish — which is correlative to the public’s right to know — with the constitutional protections given to everyone accused of a crime\, no matter how heinous. \nOne of the most difficult factual scenarios presented by such a collision arises in the context where the news media publishes articles based on confidential or private information that the reporter obtained in violation of a court order prohibiting its dissemination. As well as the conflicts that result from constitutional tensions (“free press vs. fair trial”)\, core conflict of laws principals are implicated when the reporter gathering the information is acting under color of the law of a state that provides an absolute privilege for such activities\, but the criminal prosecution that gave rise to the non-dissemination order occurs in another state with another body of law\, a state where the reporter is accorded\, at best\, only a qualified privilege. \nThe lecture by Visiting Guest Professor Simon\, which should be of interest to everyone concerned with comparative law and conflict of laws issues\, discusses and analyzes these conflicts in depth\, and suggests a mechanism by which the courts may render justice where\, as here\, fundamental constitutional and statutory rights collide. Ample opportunity for questions will be offered.

DESCRIPTION:Central-local relationship is an important constitutional issue which every nation\, whether big or small\, needs to deal with. It is usually prescribed for by the constitution of the nation. The formation of the central-local relationship in a specic nation often has its historical reasons. In nations adopting a federal system\, such as the United States of America\, Australia and India\, local governments\, especially state or provincial governments\, are the basis for the establishment of federal government\, which is the central government. In nations\nadopting a unitary system\, such as the United Kingdom (“the UK”) and China\, the purpose to set up local governments is to administer the state aairs more eciently. In many nations\, either federal or unitary\, all local governments have the same kind of relationship with the central government. That means all local governments have exactly the same degree of autonomy and jurisdiction. In some other nations\, however\, due to their dierent historical development\, dierent local governments may have dierent kinds of relationship with\nthe central government. \nChina is a unitary nation adopting the people’s congress system as its form of government. There exist four kinds of local governments at provincial level\, enjoying dierent degree of autonomy in China. This lecture intends to examine the future of central-local relationship under the people’s congress system\, especially\, (i) whether the existing status of central-local relationship is compatible with the people’s congress system\, (ii) whether the current status is the best arrangement\, and (iii) if not what is the possible future development?

SUMMARY:Prof. Dozhdev - Development of Property Rights in the Russian Federation: European Legal Tradition and Post-Soviet Transition
DESCRIPTION:The system of property rights in the current Russian legal framework as well as in the proposed Draft Amendments to the Civil Code (which will be adopted in 2014) are analyzed from a comparative law perspective. \nThe lecture will focus on both the conceptual framework of property rights in the Russian legal system as well as on practical issues in regard to judicial protection\, acquisition and limitation of ownership and other real rights. In addition\, the social and economic implications of the concept of property will be discussed. \nIn a systematic analysis\, property rights according to the Continental European tradition are contrasted with concepts and notions of Common Law. In this context\, the problems of eventual legal transplantation are thoroughly assessed. The examination of the immanent reforms of the Russian Civil Code reveals principles of the European legal tradition\, stimulates critical thinking and contributes considerably to the development of professional skills.

DESCRIPTION:Gunnar HEINSOHN\, Professor emeritus of the University Bremen\, is a historian\, sociologist and economist\, who elaborated — together with Otto STEIGER — a specic theory of modern economics\, namely the theory of ownership-based economics. \nThis theory deals with a symptomatic lacune of mainstream economics — this being the absence of any theoretical explanation of money and interest in mainstream economics — and focuses on legal institutions such as rights in rem (ownership) and contracts (credit agreements) to explain the origins of money and modern business cycles. \nThe key elements of mainstream economics\, such as the pretense of universalism and the assumption of a homo oeconomicus and his self-interest driven rationality\, are amongst those building blocks of contemporary economics which are in the focus of HEINSOHN‘s (and STEIGER‘s) critique. \nAt the ocassion of his visit to Vienna\, Professor HEINSOHN will present an introduction to his theory of ownershipbased economics. The tools developed by way of this introduction will be used to engage in a description and analysis of the current systemic crisis of the globalized economy.

SUMMARY:Prof. Scott Brewer - Universality of Logic and Globalisation of Legal Analysis
DESCRIPTION:Laws of nation states and laws of logic: The law of every existing legal system is local to time\, place\, and country. That proposition is central to Legal Positivist legal theories that are so familiar to jurists (professors and students) at this august institution who are so robustly aware of Hans Kelsen’s seminal jurisprudence. That proposition is also acknowledged by any plausible “natural law” theory of law. Logic has been well and powerfully characterized\, in the work of great philosophical logicians as diverse and influential as Gottfried Wilhelm Leibniz and Gottlob Frege\, as the discipline that articulates universal “laws of thought\,” local to neither time nor place nor country nor person. \nIn this presentation I shall describe a method of analysis\, the Logocratic Method\, that provides an explanation of both law and logic that captures the locality of law and the universality of logic. I shall explain how the Logocratic Method enables\, enhances\, and empowers critical analysis of the strengths and weaknesses of legal arguments\, which are at the heart of all local legal analysis. In providing this explanation\, I share and reinterpret and articulate Leibniz’ aspiration — high and deep and\, alas\, never fully realized by him — for what he called the “new general science for the instauration and development of the sciences for the benefit of public happiness”: \nWe will present here\, thus\, a new and marvelous calculus\, which occurs in all our reasonings and which is not less rigorous than arithmetic or algebra. Through this calculus\, it is always possible to terminate that part of a controversy that can be determined from the data\, by simply taking a pen\, so that it will suffice for two debaters (leaving aside issues of agreement about words) to say to each other: let us calculate! In this way\, just as when two arithmeticians dispute about a calculation mistake\, so too the method I am proposing will yield the same solution\, including for ignorant persons or for those who are not willing to use it. . . . We will conclude with an exhortation addressed to those persons who are most illustrious by virtue of dignity and knowledge\, about their opportunity to increment immensely human happiness in a short time\, if only we wish to do so.1 \nAfter outlining the Logocratic Method\, I conclude my exploration of the locality of the laws of nation-states and the universality of logic with a brief critical discussion of a legal paradox that Leibniz addressed in his doctoral dissertation on law\, a “perplexing” case that he sought to resolve as part of his lifelong effort to bring “the light of reason” to law through the use of logic. I argue that Leibniz\, great master of logic though he was\, failed to use the full resources of logic to resolve this particular paradox\, and that the Logocratic Method\, properly applied here\, provides one example of the deep utility of logic for explaining how legal argument both can\, and all too often does\, fail to meet the legitimate demands of universal logical integrity. \n1: Gottfried Wilhelm Leibniz: The Art of Controversies. SUMMARY:Dr. Fan Yang - Mediation and its Impact on Legal Systems in Asia-Pacific
DESCRIPTION:Mediation plays an ever more important role in the resolution of disputes around the world. While attention to mediation continues to grow both within and outside of the Asia-Pacific region\, scholarship and research on the impact of mediation on legal systems and legal cultures remains sparse. Before a meaningful comparison of the role that mediation plays in different legal systems can be advanced\, some fundamental questions need to be answered. \nAlthough Asian cultures traditionally favour harmony and reconciliation over litigation and adjudication\, this broad generalization requires careful analysis of regional diversity and its underlying reasons\, as will be demonstrated by the study presented in this lecture. Differences in understanding are likely to be at their greatest when parties from different jurisdictions interact through the mediation process. Even where parties are from jurisdictions with similar laws\, cultural differences may lead to significantly different views of what constitutes appropriate or effective mediation practice. \nThis lecture presents a comparative study of the mediation practice in some selected jurisdictions\, including Australia\, Austria\, Canada\, China (Mainland)\, Chinese Taipei\, Hong Kong SAR\, India\, Indonesia\, Japan\, Korea\, New Zealand\, Singapore\, Thailand and the United States. It seeks to provide some valuable insights into the issues facing the mediators\, jurists\, practitioners and scholars in the respective jurisdictions.

Autriche) et la CJUE font preuve d’une grande prudence\, pourrait s’affirmer peu à peu un véritable principe de libre circulation des mariages homosexuels (et au delà des situations familiales) valablement créés à l’étranger\, dans le prolongement des arrêts Wagner c. Luxembourg et Négrépontis-Giannisise c. Grèce de la Cour EDH et de des arrêts Garcia Avello et Sayn-Wittgenstein de la CJUE.

DESCRIPTION:Further to providing a picture of the international recovery of child support before the 2007 Hague Child Support Convention and presenting an overview of the 2007 Hague Child Support Convention\, Mr. Lortie will highlight the practical challenges in this area of the law such as the increasing number of divorces and the resulting number of child support cases\, the budget crises experienced by many States and the role of States in providing welfare\, social security payments in lieu of the child support that should normally be provided by the parents. \nAgainst this background\, Mr. Lortie will present opportunities for domestic law reforms in relation to the recovery of child support with respect to matters such as: effective access to procedures (e.g.\, administrative versus court-based systems); the location of the debtor; the establishment of parentage; the determination of the amount of maintenance to be paid; the swift recognition\, enforceability and effective enforcement of decisions; information technology; and\, questions of applicable law.

DESCRIPTION:Die interdisziplinäre Tagung befasst sich mit der Bedeutung der Komparatistik in ihrer Funktion als Auslegungsmethode des Rechts. Die Palette der hier angesprochenen Fachbereiche umfasst Kollisionsrecht\, Zivilrecht\, Verfahrensrecht\, Strafrecht\, Verfassungs- und Verwaltungsrecht sowie Völker- und Europarecht. Dabei werden nicht nur methodische Überlegungen zur Rechtsvergleichung aus Sicht der einzelnen Disziplinen angestellt\, sondern es wird auch die konkrete Judikatur österreichischer und europäischer Höchstgerichte darauf hin untersucht\, ob und unter welchen Bedingungen Rechtsvergleichung als Methode der juristischen Interpretation und damit auch in der Rechtspraxis Anwendung findet. Die Tagung strebt wissenschaftliche Erkenntnisse darüber an\, ob juristische Disziplinen und Höchstgerichte die rechtsvergleichende Methode unterschiedlich anwenden und auf welche Ursachen dies zurückgeführt werden kann. Insbesondere wird dabei auf folgende Fragestellungen eingegangen: Lassen sich in Lehre und Praxis aktuelle Tendenzen feststellen\, die Rechtsvergleichung stärker als Auslegungsmethode heranzuziehen? Welche Rolle spielen hierbei europäische und globale Integrationsprozesse? Dieser Entwurf soll das materielle Recht für internationale Käufe regeln\, dabei aber nicht nur Verbraucherkäufe\, sondern auch grenzüberschreitende Käufe zwischen bestimmten Unternehmen erfassen. Nun besteht für transnationale Kaufgeschäfte zwischen Kaufleuten aber seit langem das wohleingeführte und weltweit erfolgreiche Wiener UN-Kaufrecht (CISG). Dieses Nebeneinander gibt dringenden Anlass\, sich eingehend mit dem Verhältnis der beiden Instrumente zueinander zu beschäftigen. Macht das Europäische Kaufrecht neben dem CISG Sinn? Wie weit überschneiden sich beide Regelungen? Genügt der optionale Charakter des GEKR/CESL für ein spannungsfreies Nebeneinander? Neben einem Überblick über die wesentlichen Grundzüge des neuen Entwurfs sind Antworten auf diese Fragen zu geben.

Danach betrachtet er Gesetze in angrenzenden Rechtsgebieten\, deren Funktion durch das Immigrationsrecht beschränkt wird. Diese Gesetze regulieren die rechtliche Stellung von Ausländern\, die erst dann abgesichert ist\, wenn die Betroffenen in Japan wohnberechtigt sind. Der Vortragende argumentiert\, dass das Immigrationsrecht und die angrenzenden Rechtsgebiete eng verbunden betrachtet werden sollten.

Gesetzesauslegung unkritisch als selbstverständlich wahrgenommen werden\, erscheinen bei Reformprojekten plötzlich problematisch. Zahlreiche Entwürfe\, die heute die existierenden Formen des juristischen Denkens de lege ferenda in Frage stellen und eine Rechtfertigung von jenen herausfordern\, die möglicherweise Bedenken gegen Reformen hegen\, belegen oft mangelnde Einsicht in die historischen und dogmatischen Grundlagen der betroffenen Rechtsordnung und Rechtstradition. \nIm Rahmen der umfassenden Reform des russischen Zivilrechts betreffen viele Änderungsvorschläge das allgemeine Schuldrecht. So sind etwa der Inhalt des Schuldverhältnisses\, seine Systematisierung nach dem Entstehungsgrund und sein Anwendungsbereich ebenso sowie die Modalitäten der Drittleistung von der Reform erfasst. Wohl am weitesten geht das Reformprojekt\, wenn es den Grundsatz der Naturalerfüllung in das russische Recht einführt. \nDr. Andrey Shirvindt unterzieht die diversen Vorschläge einer rechtlichen Analyse und Würdigung.

DESCRIPTION:In the post-industrial era ever more goods\, services\, persons and capital cross national borders. Business organizations – companies\, corporate groups and state-owned enterprises – “enter” and “exit” states offering goods and services according to their business needs. Each of these requires coordination of the legal systems in which the various activities take place\, in order to inspire confidence that an activity undertaken in the territory of one country will not be frustrated in another. \nThe presentation will explore the coordinating role of private international law\, on an international level as well as within each national system. The legislature has to take account of cross-border effects of its legislation also when enacting statutes that\, on their face\, seem to concern purely domestic matters. Private international law provides courts with tools that enable coordination even in the absence of legislation\, such as the preliminary question\, renvoi\, and the application of economic conflict-of-law rules. Occasionally\, there may be need to coordinate results obtained under religious law and secular law. In certain matters there is need for coordination on an administrative and regulatory level. Finally\, coordination has also its limits and some of those will be addressed.

DESCRIPTION:Contemporary accounts of corporate legal evolution view lawmakers as highly responsive to the economic interests of both pressure groups and markets. Through this lens law is understood to be the product of pressures exerted by managers\, investors\, institutional shareholders and the Federal Government\, and the incentives of state lawmakers to accommodate the interests of these pressure groups. This view dominates the current understanding of corporate legal evolution in the United States and is becoming highly influential in comparative accounts of corporate legal variation. \nThis lecture sounds a note of objection: it argues that the disciplinary pendulum has swung too far toward external accounts of legal evolution and too far away from internal accounts of legal change\, which view the path of law\, at least in part\, as the product of the internally generated constraints of the legal system. Contrary to the dominant account of the evolution of self-dealing law in the United States\, the contemporary self-dealing rule is not the unexplained product of external market pressures but is the logical product of the path of fiduciary law trodden through the corporate conception. The lecture shows that for contemporary corporate law a significant dose of inevitability was administered at the inception of general incorporation.

SUMMARY:Prof. Olga Khazova - Family Law in the Post-Soviet European Territory: What does it look like?
DESCRIPTION:As the result of the dissolution of the Soviet Union in 1991\, new independent states were formed on European territory: Armenia\, Azerbaijan\, Belarus\, Estonia\, Georgia\, Latvia\, Lithuania\, Moldova\, Russia\, and Ukraine. This served as an impetus to extensive law reforms in these countries. Family law reform was a constituent part of this revision. It had to be adapted to the new social and economic realities\, which were brought to these countries together with tremendous political changes. In the former USSR\, the Soviet republics did not have a lot of freedom in designing their own family laws; all the codes on marriage and the family were practically the same\, being based on the Fundamentals of the Legislation of the USSR and Soviet Republics on Marriage and the Family and having\, in fact\, the Russian Federation (at that time RSFSR) Code on Marriage and the Family 1969 as a common compulsory model. Therefore it is not surprising that after these countries became independent and were released from the pressure of the Soviet state\, a completely different picture of family law emerged. \nThe lecture will focus on the main changes that were introduced into family law of the post-Soviet European countries; it will attempt to explain the existing diversity in legal regulation\, as well as reveal the main trends in post-Soviet European family law.

DESCRIPTION:Wenn und soweit Recht die Steuerung menschlichen Verhaltens zum Gegenstand hat\, erscheint es durchaus nahe liegend\, die Augen nicht vor den grundlegenden Erkenntnissen zu verschließen\, die die Sozialwissenschaften über eben dieses menschliche Verhalten zutage gefördert haben. \nDas neoklassische Konzept des homo oeconomicus und die sich daraus ergebenden Schlussfolgerungen\, die das heute weitgehend etablierte Kon-zept von Law & Economics charakterisieren\, sind ein eindrücklicher Beleg für die Verständnis- und Erkenntnisgewinne\, die sich erzielen lassen\, wenn die Grenzen der eigenen Disziplin überwunden und deren Lehren (auch) dem Prüfstand extradisziplinärer Forschungsergebnisse ausgesetzt werden. \nUngeachtet der Erfolgsgeschichte von Law & Economics mehren sich die Stimmen\, die zwar nicht an der generellen Überzeugungskraft eines solchen interdisziplinären und insbesondere sozialwissenschaftlichen Analyseansatzes für das Phänomen Recht\, aber doch an der uneingeschränkten Anwendbarkeit der Prämissen zweifeln\, auf denen der standardökonomische Ansatz beruht. \nDie Verhaltensökonomik ist eine solche wissenschaftliche Strömung\, die anhand empirischer Untersuchungen u.a. herauszuarbeiten versucht\, wo und inwiefern sich in der Realität systematisch auftretende Verhaltensweisen beobachten lassen\, die aus traditioneller ökonomischer Sicht letztlich nur als Anomalien erklärbar sind. Auf diese Weise möchte sie das vorhandene Erklärungsinstrumentarium erweitern und verfeinerte Prognosemöglichkeiten vor allem dort bieten\, wo wirklichkeitsnähere Grundannahmen besonders gefordert sind. \nNach einer einführenden Vorstellung der konzeptionellen Eckpunkte der Verhaltensökonomik soll anhand einiger ausgewählter Beispiele der Frage nachgegangen werden\, inwiefern verhaltensökonomische Erkenntnisse auch im Zusammenhang mit rechtlichen Fragestellungen von Nutzen sein können. \nDer Vortrag richtet sich an interdisziplinär interessierte JuristInnen und erfordert keine Vorkenntnisse.

DESCRIPTION:The non-retroactivity of crimes and punishments has become a rule of customary international law. How it did so is an interesting and complex story about the use of comparative law in the making of international law. \nThis rule of international human rights law can be demonstrated as rigorously from practice and opinio juris as any other rule of customary international law. It is sometimes said that less evidence of state practice is necessary to treat an international human right as customary international law. Rules of human rights law\, however\, are far safer and more secure if grounded in practice as well as opinio juris. Legality is an excellent tool for making such a demonstration of technique in human rights law. \nBecause legality\, as with other human rights\, concerns the relationship between states and their own nationals\, not just states and others’ nationals\, a wider variety of practice sources needs to be considered than is often used in deal with evidence of customary international law that concerns only state interactions with each other. In addition\, the practice and opinio juris of international organizations\, including international tribunals\, has become primary evidence for (not just a subsidiary means of determining) customary international law. \nComparative law technique is necessary to determine the specific content of this rule. Without comparative analysis\, it would be difficult to determine which of the many versions of legality in the laws of national and international tribunals constitutes the version required by international law.

DESCRIPTION:One constitutes oneself as a comparatist by rejecting the fixity of conceptually homogenized understandings and by marking a third location that is neither one nor the other but\, disputing the territories of both\, something else besides. For the comparatist-at-law\, the third space is distinguishable from the laws being compared (it is neither outside or astride those laws) while not being reducible to a composite of the pre-existing laws. In the third space\, there takes place a re-articulation projecting meaning beyond any signification obtaining in the situated laws. As it displaces them\, the third space can properly be regarded as effectuating an othering of those laws. The third space introduces another other to the comparison-at-law (when it comes to comparison\, one plus one makes three). Indeed\, emerging beyond any antecedent information\, beyond any ”either/or” or ”both/and” scenario\, the third space offers a space of contestation and transaction disrupting each law’s assumed totalization\, a translational space where meanings are dismantled or deconstructed\, but also acts as a powerful site of reconstitution and meaning productivity. In the third space\, new knowledge is fabricated. It is crucial\, therefore\, not to think of the third space as a dialectical arrangement à la Hegel\, which would be much too strongly predicated on ideal temporal sequencing and on the no less ideal unfolding of the thesis/antithesis/synthesis scheme — which would mark the termination of a process. Instead\, what we have in the third space — through the thirding of legal knowledge — is the unfolding of an interminable heterothesis.

SUMMARY:Prof. Dr. Nuray Ekşi - Recognition of “Religious Marriages” and “Non-judicial Divorces” in Private International Law
DESCRIPTION:Each country shapes its family law to a great extent in accordance with the traditions\, customs and religious values inherently dominant in its own country. Therefore\, what is usual and natural in one jurisdiction could be regarded as a strange practice in another. Religious marriages and divorces are typical examples of institutions which can be perceived in a multitude of different ways due to cultural particularities. Thus\, conflicts arise between the laws of countries with different legal philosophies and cultural traditions. The difficulties become greatest when the conflict is between the laws of countries without any common legal or cultural tradition. Prof. Dr. Ekşi will discuss the following essential question: to what extent are religious marriages such as polygamous marriages\, proxy marriages\, muta marriages\, arranged and forced marriages recognized as valid in private international law. Prof. Dr. Ekşi will also focus on the recognition of administrative and religious divorces which is another extremely difficult issue to reach a proper conclusion for. It will also be discussed in a comparative manner whether divorce by a letter of the husband or talaq or khula\, whether religious divorces in Jewish Rabbinical law or in Islamic law are recognized under national private international laws as well as international conventions or the Brussels II Regulation.

SUMMARY:Prof. Anton Cooray - Bridges across legal traditional divides: Oriental and Occidental Laws in Sri Lanka
DESCRIPTION:Comparative lawyers have been fascinated by the challenges that are thrown by legal transplants. In mixed jurisdictions where two or more legal traditions have taken root comparative jurists are able to observe how these legal traditions sometimes conflict and sometimes mingle with each other. \nIn the case of Sri Lanka where Colonial masters found fairly well developed indigenous laws the introduction of their laws have had to be done in not a destructive way but in a complimentary manner. The British Colonial administration which is responsible for forming the present state of law and legal system in Sri Lanka respected not only the indigenous laws but also the Roman Dutch law that had been introduced by their predecessors the Dutch. \nLegislative reforms during the British Rule continued into the post-colonial period and have modernized the law but not completely uprooted the indigenous laws and legal traditions. In a similar vain judges\, both British and Sri Lanka\, have interpreted relevant statutes and customary laws to minimize friction between local customs and the received laws.

DESCRIPTION:Against the background of globalization\, contemporary international economic law has the features of internationalization of national norms and domestication of transnational provisions. By its side\, a case law is emerged which is relied upon by both institutional and ad hoc dispute resolution bodies. \nAs services and investment are inseparable in nature\, the dichotomies between the norms governing international trade and those regulating international investment are transcended. At the same time\, the number of participants in both trade and investment has greatly increased and will continue to grow. \nThese developments have posed challenges to the current regime. The international community must consider alternatives for improving the system of international economic law and give directions to its future development.

DESCRIPTION:The US law of international commercial arbitration is for the first time the subject of a “Restatement of the Law” by the American Law Institute — a project designed\, like all US Restatements\, to bring coherence and some progressive thinking to a body of American law in great need of that. Portions of the Restatement (notably recognition and enforcement of international awards) have been completed and approved. Others (notably confirmation and annulment of awards) are in draft form. And still others (notably enforcing the arbitration agreement\, judicial intervention in arbitral proceedings\, and investor/state arbitration) still remain to be launched.\nProfessor George Bermann\, of Columbia Law School and Chief Reporter of the Restatement\, will present both the general lines of debate surrounding the Restatement\, and identify and discuss the most salient concrete issues that have arisen and have been — or will soon be — resolved.
