Martin Belov will present the transition from Westphalian to post-Westphalian constitutionalism in the light of the concept of constitutional geometry. Constitutional geometry is a new analytical paradigm of constitutional semiotics. It is paradigm which tries to detect, analyze, deconstruct and explain the different shapes and forms used as explanatory and ordering schemes by the constitution and the constitutional law. The main thesis of the presentation is that we are currently undergoing a massive constitutional shift from Westphalian to post-Westphalian constitutionalism produced by three main phenomena: globalization, information revolution and mobility revolution.

Dans un monde « globalisé »,systèmes et ensembles normatifs entrent en relation les uns avec les autres. Des interac-tions se produisent à différents niveaux: aux phénomènes d’interactions mutuelles, i.e. entre deux ensembles normatifs, s’ajoutent des phénomènes d’interactions plurielles mettant en jeu plusieurs ensembles normatifs. Ces interactions entre normes qui s’influencent mutuellement, produisent un effet de levier qui, à bien des égards, accélère les évolutions : c’est l’hypothèse de la « dynamique des normes ». Parce qu’il est fortement marqué par le droit européen et par les droits fondamentaux, le droit de la famille constitue une sorte de laboratoire de ces phénomènes.

Als Privatscheidungen gelten Ehescheidungen, die ohne oder nur mit deklaratorischer Beteiligung eines Gerichts oder einer Behörde vorgenommen werden können. Derartige Scheidungen waren bis vor Kurzem vor allem außerhalb Europas bekannt. In jüngerer Zeit besteht allerdings auch in einigen Mitgliedstaaten der EU die Möglichkeit einer rechtsgeschäftlichen Scheidung; dies gilt namentlich für das italienische, spanische und französische Recht. Der Vortrag beschäftigt sich mit der Frage, inwiefern Scheidungen ohne konstitutive Beteiligung eines Gerichts oder einer Behörde auch außerhalb des Scheidungsstaats Wirkung zeitigen können. Die Anerkennung im Ausland vollzogener Privatscheidungen kann dabei in unterschiedlichem Kontext relevant werden: Die Eheschließung mit einem anderen Partner ist ebenso angesprochen wie etwa unterhaltsrechtliche, steuerrechtliche oder erbrechtliche Konsequenzen.
